Terms of Use

These Terms of Use ("Terms") govern your use of supportfund.com and related SupportFund services (collectively, the "Services"). The Services are operated by School Fundraising Coach, LLC, doing business as SupportFund ("SupportFund," "we," "us," or "our").

By using the Services, you agree to these Terms. If you do not agree to these Terms, please do not use the Services.

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised Effective Date. Your continued use of the Services after changes are posted means you accept the updated Terms.

1. SupportFund Services

SupportFund provides online fundraising technology that allows schools, teams, clubs, and other organizations and their participants to conduct fundraising campaigns, collect donations, sell products, and manage fundraising activities.

SupportFund provides technology and payment-related services for fundraising campaigns but does not control how individual fundraising campaigns are conducted by participating schools, teams, organizations, or participants.

SupportFund does not guarantee that any fundraising campaign will raise a particular amount or achieve a particular fundraising result.

2. Accounts

Certain features require you to create an account. You agree to provide accurate and current information and to keep your account information updated.

You are responsible for maintaining the confidentiality of your username and password and for activity occurring through your account. You agree to notify SupportFund promptly if you believe your account has been accessed without authorization.

You may not sell, transfer, or share your account credentials with another person.

3. Age Requirements

The Services are intended for individuals who are 13 years of age or older.

Individuals under 13 may not create or independently use a SupportFund account.

Where a school, team, or organization uses the Services in connection with individuals under 13, the organization and SupportFund will handle the collection and use of information in accordance with applicable law and the applicable agreement between the organization and SupportFund.

4. Fundraising Campaigns and Donations

Fundraising campaigns are conducted for schools, teams, clubs, and other organizations or beneficiaries identified in the campaign.

Information about a fundraising campaign, including its purpose, beneficiary, participant, and fundraising claims, is provided by the participating organization or fundraising participant. SupportFund is not responsible for the accuracy of information provided by participants or organizations.

Donations are generally final once submitted. If a donation was made in error, please contact SupportFund promptly at info@supportfund.com. Any refund will be handled in accordance with the circumstances of the transaction and applicable law.

You agree not to use a payment card or other payment method without authorization.

If you believe your payment information has been used without authorization, you should contact your financial institution or card issuer immediately.

5. Product Purchases and Delivery

Product purchases made through fundraising campaigns are subject to the terms presented at the time of purchase.

Unless otherwise stated, products selected for delivery through a fundraising participant will be delivered to the participating school, team, organization, or fundraising group for distribution.

SupportFund is not responsible for a participant's failure to distribute an item after the item has been delivered to the participating organization or group.

6. Fundraising Proceeds

SupportFund processes fundraising payments on behalf of participating organizations and beneficiaries.

Unless otherwise provided in an agreement with the participating organization, fundraising proceeds will be distributed to the designated beneficiary after the applicable campaign ends, less applicable product costs, fees, and other amounts agreed to with the organization.

Specific payment, fee, and disbursement terms may be established in a separate agreement between SupportFund and the participating organization.

7. Text Messages

If you voluntarily provide your mobile phone number and opt in to receive text messages from SupportFund, you may receive text messages relating to fundraising campaigns that you are participating in.

Message frequency varies. Message and data rates may apply.

Consent to receive text messages is not required to participate in a fundraiser, use SupportFund services, make a purchase, or make a donation.

You may opt out of text messages at any time by replying STOP. You may request assistance by replying HELP or by contacting info@supportfund.com.

After you opt out, you may receive a final confirmation message. You will no longer receive SupportFund text messages unless you opt in again.

Carriers are not liable for delayed or undelivered messages.

8. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law or regulation;
  • Fraudulently obtain money, products, or information;
  • Use another person's account without authorization;
  • Interfere with or attempt to disrupt the Services;
  • Access information or systems that you are not authorized to access;
  • Upload or transmit malicious software; or
  • Provide information that is unlawful, fraudulent, threatening, defamatory, obscene, or that infringes the rights of another person.

SupportFund may suspend or terminate access to the Services if we reasonably believe these Terms have been violated.

9. User Information

Users may provide information through the Services, such as fundraiser information, contact information, and other information needed to operate a fundraising campaign.

You are responsible for ensuring that information you provide is accurate and that you have the right to provide it.

You agree not to provide information that is unlawful, fraudulent, defamatory, or that violates another person's rights.

10. Intellectual Property

The SupportFund website and Services, including their software, design, text, graphics, logos, and other content provided by SupportFund, are owned by or licensed to SupportFund and are protected by applicable intellectual-property laws.

Except as permitted by law or expressly authorized by SupportFund, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the SupportFund Services or their content.

11. Privacy

Your use of the Services is also subject to our Privacy Policy, which explains how SupportFund collects, uses, and protects personal information.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available." SupportFund does not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

To the maximum extent permitted by law, SupportFund disclaims warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, SupportFund and its officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services.

To the maximum extent permitted by law, SupportFund's total liability arising from your use of the Services will not exceed the amount you paid directly to SupportFund for the transaction or service giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

14. Taxes

SupportFund does not determine whether a particular donation is tax deductible. Donors should consult their tax advisor regarding the tax treatment of donations.

15. Changes or Termination of Services

SupportFund may modify, suspend, or discontinue all or part of the Services at any time.

SupportFund may suspend or terminate an account or access to the Services if we believe the account has been used in violation of these Terms, applicable law, or for fraudulent or unauthorized activity.

16. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.

Any dispute arising from these Terms or the Services will be subject to the applicable state or federal courts located in Utah, unless applicable law requires otherwise.
